Snapcaster Terms of Service

1. Agreement to these Terms

We are Eppler Software ("Snapcaster", "we", "us", "our"), a company registered in Canada at Victoria, British Columbia. We operate the website snapcaster.ca and the related products and services that link to these Terms (together, the "Services"). You can contact us at info@snapcaster.gg.

These Terms are a binding agreement between you and Eppler Software. You accept them by creating an account, by placing an order (including as a guest), by registering as a Seller, or by continuing to use the Services. Each order you place is placed under the version of these Terms in effect at that time, as shown by the effective date above.

If you do not agree to these Terms, do not use the Services.

We may update these Terms. When we make a material change we will update the effective date and give reasonable notice, such as a notice on the site or an email to account holders, before the change applies to you. Prior versions are available on request.

2. What Snapcaster is

Snapcaster provides two distinct services for trading card game (TCG) products in Canada:

  • Price comparison. We index inventory from Canadian online retailers and link you to their own websites. Purchases you make on a retailer's website are made with that retailer, on their terms, and are not processed by Snapcaster in any way.
  • The Snapcaster marketplace. Verified Canadian retailers ("Sellers") list single cards for sale, and you buy from one or more Sellers in a single checkout processed by Snapcaster.

Sections 5 through 9 apply to the marketplace. Section 10 applies to Sellers. Everything else applies to all use of the Services.

3. Eligibility

You must be at least 13 years old to use the Services. If you are a minor where you live, you may only use the Services with the permission and supervision of a parent or guardian who agrees to these Terms on your behalf.

The marketplace ships within Canada only, and all marketplace transactions are in Canadian dollars (CAD).

4. Accounts and guest checkout

You are responsible for your account credentials and for activity under your account. Keep your email address current; it is how we and Sellers reach you about orders.

You may place marketplace orders without an account ("guest checkout"). Guest orders are subject to these Terms exactly as account orders are. Order history for guest orders is not durably accessible without an account, so keep your confirmation email.

5. The marketplace: who you are buying from

When you buy on the marketplace, the contract of sale is between you and the Seller. Snapcaster is not a party to the sale, does not own or inspect the cards, and is not the seller of record.

Snapcaster provides the platform services around the sale:

  • We display Sellers' listings and operate the cart and checkout.
  • We process your payment as each Seller's limited payment collection agent. Payment made to Snapcaster satisfies your payment obligation to the Seller.
  • We operate the cancellation and refund machinery described in section 8, and where we say a refund will be made, we execute it.
  • We collect and remit sales taxes on marketplace transactions as a marketplace facilitator, where required by law (section 9).

If something goes wrong with an order, your recourse under the contract of sale is against the Seller, but we do not leave you alone with it: we will work with you and the Seller in good faith to put the order right, using the tools in section 8. This assistance is a service commitment, not a guarantee of any particular outcome.

6. Marketplace fees and pricing

Purchases of single cards through Snapcaster checkout incur a purchase fee of 4.2% of the card subtotal. The fee is itemised and shown before you pay, and appears on your receipt. Sealed products are not sold through Snapcaster checkout and carry no purchase fee.

Shipping is charged per Seller at the rate shown at checkout. Item prices, availability, and shipping options are set by Sellers and may change until a checkout session is created; only a checkout session fixes prices.

We may change the purchase fee rate by amending these Terms; a change applies only to orders placed after it takes effect.

7. Payments

Payments are processed by Stripe. We do not receive or store your card number. Available payment methods are shown at checkout, and all charges are in CAD.

By placing an order you authorise the charge for the full checkout total: items, shipping, the purchase fee, and any applicable taxes.

8. Cancellations, refunds, and problems

Order statuses. An order moves through Placed, Preparing, Shipped, and Delivered, and can terminate as Cancelled or Refunded. You can follow it from your order history (account orders) or your confirmation email.

Cancelling before shipment. Before an order ships you may submit a cancellation request from the order page. The Seller either honours it (cancelling the order) or declines it with a reason. Cancellation requests are not available once an order has shipped.

What is refunded when an order is cancelled. When an order is cancelled before shipment, you are refunded the cancelled items, shipping (on a full cancellation), and the taxes attributable to the refunded amounts. The purchase fee is treated as follows:

  • If the Seller cancels your entire order before shipment, you are also refunded the order's share of the purchase fee. You are made completely whole.
  • If you request the cancellation and the Seller honours it, the purchase fee is not refunded. The fee covers payment processing and platform services that were already performed, and this is disclosed again before you submit a cancellation request.
  • Partial cancellations refund the affected items and their taxes; the purchase fee is not refunded.

After shipment. If an order arrives with missing, wrong, or damaged items, contact the Seller using the contact details on your receipt as soon as possible after delivery, and copy us at info@snapcaster.gg if you need help. Sellers may resolve issues by replacement or refund. Post-shipment refunds are issued by the Seller through the platform and are refunded to your original payment method; the purchase fee is not refunded.

Refund timing. Refunds are issued to your original payment method. Banks typically post refunds within 5 to 10 business days.

9. Taxes

Where required by law, Snapcaster collects applicable Canadian sales taxes (GST/HST/PST/QST) on marketplace transactions at checkout and remits them to the tax authorities as a marketplace facilitator. Taxes, where charged, are itemised at checkout and on your receipt.

10. Seller Terms

This section applies to Sellers and is part of these Terms. You accept it expressly when you register as a Seller. It is written to stand alone: if we later publish it as a separate Seller Agreement, the obligations carry over unchanged.

10.1 Becoming a Seller

Selling on Snapcaster currently requires operating a Canadian retail store and connecting your inventory through a supported inventory platform; listings sync from your system rather than being created on Snapcaster directly. We review applications through our store intake process and may accept or decline them at our discretion.

Payouts require completing onboarding with our payment processor (Stripe Connect). Your payout account, identity verification, and bank details are handled by Stripe; we never hold your banking credentials.

10.2 Listings

You are responsible for the accuracy of your listings: card identity, condition, language, finish, price, and quantity. Card conditions use the marketplace scale (NM, LP, MP, HP, DMG) and must be graded honestly. You must only list items you physically hold and can fulfil.

10.3 Fulfilment

You must fulfil orders promptly. The marketplace standard is shipping within 3 business days of order placement, with the order's status kept current (accepted, shipped with tracking where available, delivered). Orders that you do not fulfil do not become payable (section 10.5).

Repeatedly missing the fulfilment standard, excessive cancellation rates, chronic inventory drift, or unresponsiveness are conduct violations and may lead to the remedies in section 10.7.

10.4 Seller fees

The following fees apply to each marketplace order and are deducted before payout:

  • a marketplace fee of 5% of the merchandise price, capped at $50 per item;
  • a payment processing fee of 2.9% + $0.30 on the order total including shipping.

Fee amounts are itemised per order in your payout ledger. We may change seller fees by amending these Terms with notice; a change applies only to orders placed after it takes effect.

10.5 Payouts and holds

Payouts are per order, transferred to your Stripe account. An order becomes eligible for payout after it is marked shipped and its hold window has passed; eligible transfers are released on a rolling basis.

Hold windows are set per Seller and may be adjusted, including longer windows for new Sellers until a track record is established, or in response to disputes or risk signals. Your current hold window is shown in your Seller dashboard.

If you cancel an entire order before shipment, the buyer is made completely whole, including the purchase fee (section 8). We may recover costs from Sellers whose cancellation rates are excessive.

10.6 Taxes and records

Where marketplace facilitator rules apply, we collect and remit sales taxes on your marketplace sales (section 9). You remain responsible for your own income tax and business records, and for any tax obligations outside our facilitator scope.

10.7 Suspension and removal

We may pause your listings, remove listings, withhold pending payouts where the law and our payment processor permit, or suspend or terminate your Seller account for material or repeated breach of these Terms, fraud, or risk to buyers or the platform. Orders already placed at the time of a pause or suspension must still be fulfilled or cancelled per section 8. You may pause your own store at any time (vacation mode); existing orders are unaffected and must still be fulfilled.

11. Snapcaster Pro subscriptions

Snapcaster Pro is an optional monthly subscription for price-comparison features. Your subscription renews automatically each month until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing cycle, and no partial-month refunds are given. We may change the subscription fee with prior notice; changes apply from your next billing cycle.

12. Acceptable use

You must not:

  • use the Services to break the law, defraud anyone, or infringe others' rights;
  • scrape, harvest, or bulk-extract data from the Services, or access them by automated means except through interfaces we provide for that purpose;
  • interfere with the operation or security of the Services;
  • misrepresent your identity, listings, or orders, or manipulate prices, reviews, or fees;
  • place orders with no intention to complete them, or abuse the cancellation machinery;
  • resell or sublicense the Services themselves.

13. Intellectual property

The Services, including their software, design, and content we author, belong to Eppler Software or its licensors. Card names, images, and game-related trademarks belong to their respective owners (for example Wizards of the Coast); Snapcaster is not affiliated with or endorsed by them. We grant you a limited, revocable, non-transferable licence to use the Services as they are intended to be used, and no other rights.

14. Third-party websites

Price-comparison results link to retailers' own websites. We do not control those sites, and purchases there are governed by the retailer's own terms and policies, not these Terms.

15. Disclaimers

The Services are provided "as is" and "as available". Price-comparison data is indexed from third parties and may be stale or wrong; the retailer's own website has the final say on price and availability. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For marketplace orders, the cards themselves are sold by Sellers, and any product warranty or condition claim lies against the Seller (with our assistance under section 5).

16. Limitation of liability

Nothing in this section limits or excludes liability that cannot be limited or excluded under applicable law, and nothing in it applies to refunds: amounts owed to you under section 8 are payment obligations, not damages, and are not capped.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for all claims arising out of or relating to the Services is limited to the greater of (a) CAD $100 and (b) the fees you paid to Snapcaster (purchase fees, seller fees, and subscription fees, but not amounts passed through to Sellers for merchandise, shipping, or taxes) in the 12 months before the event giving rise to the claim.

17. Indemnification

You will indemnify us against third-party claims arising from your breach of these Terms, your listings and sales (if you are a Seller), or your unlawful use of the Services.

18. Termination

You may stop using the Services or close your account at any time. We may suspend or terminate your access for material or repeated breach of these Terms, fraud, or risk to other users or the platform. Sections that by their nature survive termination (including sections 8, 10.5, 13, and 15 through 19) survive it.

19. Governing law and disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there.

Before starting a formal proceeding, you and we agree to try to resolve any dispute informally: write to info@snapcaster.gg (or, for privacy matters, privacy@snapcaster.gg) and allow 30 days for a resolution. Disputes that are not resolved informally are subject to the exclusive jurisdiction of the courts of British Columbia.

Nothing in these Terms limits any mandatory consumer-protection rights you have under the laws of the province or territory where you live, or requires you to bring a claim outside a forum those laws guarantee you.
